We thank you for using Iberbox products and services (hereinafter, the "Services"). These Services are provided to you by Iberbox Secure Services SL (hereinafter, "Iberbox"), a company established and operating under the laws of Spain (with Tax Identification Number: B37579919), and located at Calle Adaja, nº10, Parque Científico USAL, Edificio M3, 37185 Villamayor (Salamanca), Spain.
By using our Services, you agree to be bound by these terms and conditions. We recommend that you read them carefully.
Use of our Services
You must not misuse our Services. For example, you must not interfere with the Services or attempt to access them using a method other than the interface and instructions provided by Iberbox. You may only use the Services to the extent permitted by law. We may suspend or terminate our Services if you do not comply with our policies or conditions or if we believe that your conduct may be malicious.
Your use of our Services does not make you the owner of any intellectual property rights in the Services or the content you access. You may only use the content of our Services if authorized by the owner or permitted by law. These Terms do not grant you the right to use any trademarks or logos used on our Services. Do not remove, obscure or alter any legal notices displayed on our Services.
Our services may display content that does not belong to Iberbox. This content is the sole responsibility of the entity that has made it available. Due to the point-to-point encryption system on which our Services are based, we cannot access our users' stored content to determine whether it is illegal or violates our policies. In any event, we may remove or refuse to post any content if we have reasonable grounds to believe that it violates our policies or the law.
In connection with your use of the Services, we may send you service notices, administrative messages and other information.
Some of our Services are available on mobile devices. Do not use those Services in a way that may distract you and prevent you from complying with traffic or safety laws.
Age restriction. To be able to use Iberbox, you must be at least 18 years old.
Your Iberbox account
You may need an Iberbox account to use some of our Services. You can create your own Iberbox account or it may be assigned to you by an administrator, the company you work for or an educational institution. If you use an Iberbox account assigned by an administrator, different or additional terms may apply, and your administrator may be able to access or disable your account.
To protect your Iberbox account, keep your password confidential. You are responsible for the activity that takes place on or through your Iberbox account. Try not to reuse your Iberbox account password in third party applications.
Protection of privacy and copyright
Our Privacy Policy explains how we use your personal data and protect your privacy when you use our Services.
We respond to notices of alleged copyright infringement and terminate the accounts of repeat infringers in accordance with the process set out in the Digital Millennium Copyright Act (DMCA).
If you believe that a user is infringing your copyright and you would like to report it to us, please contact us by sending an email to copyright@iberbox.com.
Your content in our Services
Some of our Services allow you to upload, send, store or receive content. If you do so, you remain the owner of any intellectual property rights you may have in that content. Simply put, what belongs to you, belongs to you.
Due to our end-to-end encryption, Iberbox will not be able to access the content you store on our Services.
Our Services can process your content and extract metadata from it, such as image previews, checksums of different parts of the files, etc. in order to provide you with better functionalities. As with the rest of the contents hosted in Iberbox, this metadata will always be encrypted on the client's side following a point-to-point encryption scheme, so that they will only be accessible by knowing the account access credentials (which are never sent to Iberbox).
In the event that you delete content hosted on our Services, we may retain encrypted data on our servers for up to 6 months to facilitate the recovery of accidentally deleted data. However, we do not under any circumstances guarantee the storage of your data once you have deleted it.
About our Services software
If a Service requires or includes downloadable software, this software may be automatically updated on your device whenever new versions or features become available. Some Services may allow you to define automatic update settings.
Iberbox software may send completely anonymized data to our servers about its operation, with the aim of correcting possible problems and improving its operation. This data will never contain personal information about users or their contents. Iberbox will keep a record of the accesses to your account based on the legal regulations applicable at all times.
Iberbox grants you a personal, worldwide, royalty-free, non-transferable and non-exclusive licence to use the software provided to you as part of the Services. The sole purpose of this licence is to allow you to use the Services provided by Iberbox and to benefit from them, as stipulated in these conditions. You may not copy, modify, distribute, sell or lend any part of our Services or the software included, nor may you apply reverse engineering techniques or attempt to extract the source code of said software, unless the law prohibits such restrictions or if you have the written consent of Iberbox.
Iberbox attaches great importance to open source software. Some of the software used by our Services is offered under an open source software licence which we will make available to you. Some of the provisions set out in the open source software licence may expressly override some of these conditions.
Catálogo de servicios (RTO, RPO, WRT, MTD)
Iberbox define, en el marco del Esquema Nacional de Seguridad (ENS), una serie de valores máximos estimados en cuanto a la recuperación de incidencias y puesta en marcha del servicio:
RPO (Recovery Point Objective): Determina la cantidad máxima aceptable de pérdida de datos (en minutos u horas) que la empresa está lista / se puede permitir.
RTO (Recovery Time Objective): En esta etapa, el sistema se recupera y vuelve a estar en línea, pero aún no está listo para la producción. El objetivo de tiempo de recuperación (RTO) determina la cantidad máxima de tiempo tolerable necesario para que todos los sistemas críticos vuelvan a estar en línea.
WRT (Work Recovery Time): En esta etapa, se recuperan todos los sistemas, se verifica la integridad del sistema o de los datos y todos los sistemas críticos pueden reanudar las operaciones normales. El Tiempo de recuperación del trabajo (WRT) determina la cantidad máxima de tiempo tolerable que se necesita para verificar el sistema y / o la integridad de los datos.
MTD (Maximum Tolerable Downtime): La suma de RTO y WRT se define como el Tiempo de inactividad máximo tolerable (MTD) que define la cantidad total de tiempo que un proceso de negocio puede interrumpirse sin causar consecuencias inaceptables.

Ventanas de Mantenimiento
En el marco del Esquema Nacional de Seguridad (ENS), se define el horario de 17h a 18h de la tarde como ventana estándar de mantenimiento del sistema y actualización de servicios, si bien el equipo TI determinará el horario más adecuado en función de la carga del sistema.
How to modify and cancel our Services
You may stop using the Services at any time, although we would regret it if you did. Similarly, Iberbox may stop providing the Services to you or add or create new limitations at any time.
We believe that you are the owner of your data and that it is important to preserve your access to it. If we discontinue a Service, we will, where possible, give you sufficient notice and allow you to remove the information from the Service.
Refunds
All subscriptions to Iberbox services are subject to the Iberbox Returns Policy in force at any given time as it appears on the Website.
Our warranties and disclaimers
Iberbox offers its Services with a commercially reasonable level of competence and diligence, and we hope that you will enjoy using them. However, we cannot make any warranties in relation to some aspects of our Services.
Neither Iberbox nor its suppliers or distributors offer specific guarantees on the Services other than those expressly set out in these conditions or in the additional conditions. For example, Iberbox does not offer any guarantee in relation to the content of the Services, their specific functions, their reliability, their availability or their ability to meet your needs. The Services are provided "as is".
Some jurisdictions provide certain warranties, such as the specific warranty of merchantability, fitness for a particular purpose and non-infringement. To the extent permitted by law, Iberbox excludes all warranties.
Responsibility for our Services
To the extent permitted by law, neither Iberbox nor its suppliers or distributors shall be liable for loss of profits, revenue, data, financial loss or indirect, special, consequential, exemplary or punitive damages.
To the extent permitted by law, Iberbox's total liability, and that of its suppliers and distributors, for any claims made under these conditions, including any implied warranties, is limited to the amount you have paid to use the Services (or, if Iberbox so chooses, the resumption of the Services).
In no event shall Iberbox or its suppliers and distributors be liable for any loss or damage which is not reasonably foreseeable.
Iberbox recognises that you may have legal rights as a consumer in some countries. If you use the Services for personal purposes, nothing in these terms and conditions or any additional terms and conditions shall limit the consumer's statutory rights which cannot be contractually waived.
Use of our Services by companies
If you use the Services on behalf of a company, the company accepts these conditions. Iberbox and its affiliates, officers, agents and employees shall not be liable for any claims, demands or actions arising out of or in connection with your use of the Services or your violation of these Terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs and attorneys' fees.
Special conditions during the test period (BETA)
The period from 1 September 2020 to 31 December 2020 inclusive, the platform will be in a testing (BETA) state. During these dates, the service may be unstable, may be interrupted or may even result in data loss. For this reason, it is not recommended to use the service during its BETA status with files or on critical systems. Iberbox reserves the right to cancel any account, and may require information from users to verify the veracity of the data provided during registration on the platform.
About these conditions
Iberbox may modify these terms and conditions or additional terms and conditions that apply to a Service to, for example, reflect changes in legislation or in the Services. We recommend that you consult the conditions periodically. Iberbox will post notices regarding modifications to these terms and conditions on this page. The modifications shall not be applied retroactively and shall enter into force no less than 14 days after the date of their publication. However, modifications affecting new features of a Service or changes made for legal reasons will be effective immediately. If you do not accept the modified terms of a Service, you must stop using that Service.
In the event of any conflict between these terms and any additional terms on any of our Services, these terms shall prevail over the additional terms.
These terms and conditions govern the relationship between Iberbox and you, and do not create any rights to which a third party may be entitled.
If you do not comply with these conditions and Iberbox does not take immediate action, Iberbox will not be deemed to have waived any rights it may have (e.g. to take action in the future).
In the event that a particular condition is not mandatory, the other conditions shall remain unaffected.
Applicable law and courts
In the event of any dispute, you and Iberbox agree to submit to the exclusive jurisdiction of the Spanish courts.
